3. SCOPE OF WORK

The Contractor agrees to provide the following services:

Pay-Per-Lead Program Includes:

  • High-converting landing page design and development (max 1 included in setup)
  • Google Ads and Facebook Ads campaign setup and management
  • Call tracking and recording system implementation
  • Lead form submission tracking and verification
  • Daily campaign monitoring and optimization
  • Monthly performance reports with lead details
  • Ongoing campaign strategy and adjustment

Client Responsibilities:

  • Provide access to Google Ads and Facebook Ads accounts
  • Maintain minimum monthly ad budget of $850-$1,500 (paid directly to ad platforms)
  • Respond to leads promptly (within your agreed business hours)
  • Provide feedback on lead quality for ongoing optimization
  • Maintain active business phone line and email for lead delivery

4. QUALIFIED LEAD DEFINITION

A qualified lead is defined as:

Phone Call: A call lasting at least ___ seconds (to be agreed upfront) from a person with clear service intent
Form Submission: A completed service request form with valid contact information and clear service need description
Service Area: Customer must be located within your defined service area
Business Hours: Lead must contact during your agreed business hours
Service Intent: Customer must have genuine need for your services (no spam, wrong numbers, or informational calls)

Non-Qualified Leads (NOT Billable):

  • Spam calls or robocalls
  • Wrong number calls or misdirected inquiries
  • Calls outside service area or business hours
  • General information requests with no service intent
  • Duplicate leads from the same customer
  • Calls shorter than agreed minimum duration

5. PAYMENT TERMS

Program Pricing:

Setup Fee (One-time) $497 $347
Per Qualified Lead - First 10 (Test Package Promo) $75 $70 each
Per Qualified Lead - 15-20 Leads $65 each
Per Qualified Lead - 25+ Leads $60 each
Monthly Ad Budget (Paid to Google/Facebook) $850-$1,500 minimum

Promotion Details: $150 OFF setup fee + tiered lead pricing. First 10 leads at $70 (promo price) to test the program. Pricing scales based on monthly volume.

Payment Schedule:

REQUIRED BEFORE CAMPAIGN LAUNCH:

Setup Fee: $347 (one-time)

Test Package (First 10 Leads): $700 prepaid
(10 leads × $70 each = $700 paid in advance)

Total Due Before Start: $1,047

Campaign cannot begin until this payment is received in full

After Test Package:
Once the first 10 leads are delivered, all subsequent leads are invoiced monthly at the tiered rates ($65 or $60 per lead depending on volume)
Invoiced on the 1st of each month for qualified leads delivered in the previous month

Monthly Billing (After First 10 Leads):
Payment due NET 7 days from invoice date
Example: February leads invoiced March 1st, payment due March 8th

Ad Budget:
Paid directly by Client to Google Ads/Facebook Ads (separate from lead fees). Minimum $850-$1,500/month recommended.

⚠️ Late Payment: A 2.5% fee will be applied to payments received after the 7-day deadline.

6. PERFORMANCE GUARANTEE

Risk-Free Guarantee

If we don't deliver qualified leads that meet your agreed criteria, you don't pay for them. You only pay for leads that:

  • Meet all qualification criteria defined in Section 4
  • Are verified through call recordings or form submissions
  • Can be disputed within 7 days of delivery with valid reason

Lead Dispute Process: If you believe a lead doesn't meet qualification criteria, submit a dispute within 7 days with supporting documentation. Contractor will review call recording/form and issue credit if lead is found non-qualifying.

7. TERMS & CONDITIONS

7.1 Contract Duration & Cancellation

This agreement is month-to-month with no long-term commitment required. Either party may cancel with 30 days written notice. Upon cancellation, Client is responsible for all qualified leads delivered up to the termination date. Setup fee is non-refundable after campaign launch.

7.2 Ad Budget & Campaign Management

Client maintains ownership and payment responsibility for Google Ads and Facebook Ads accounts. Contractor requires admin access for campaign management but does not control budget spending. Client sets daily/monthly budget limits directly in ad platforms. Recommended minimum ad spend: $850-$1,500/month for optimal results.

7.3 Lead Quality & Verification

All phone leads are recorded for quality verification. Form submissions are tracked with timestamp and IP address. Client has 7 days to dispute any lead that doesn't meet qualification criteria. Disputed leads will be reviewed and credited if found non-qualifying.

7.4 Landing Page & Intellectual Property

Setup fee includes one high-converting landing page. Additional landing pages available at separate pricing. Upon contract termination and full payment, Client retains rights to landing page content. Contractor retains right to use project in portfolio unless otherwise agreed in writing.

7.5 Performance Expectations

While Contractor will optimize campaigns for maximum lead generation, actual lead volume depends on market conditions, competition, ad budget, and Client's service area. Contractor does not guarantee specific lead quantities but guarantees Client only pays for qualified leads delivered.

7.6 Client Response Time

Client agrees to respond to leads promptly during agreed business hours. Slow response times may result in lower lead conversion rates and customer dissatisfaction. Contractor is not responsible for lost opportunities due to Client's delayed response.

7.7 Limitation of Liability

Contractor's liability shall not exceed the total amount paid by Client in the previous 3 months. Contractor is not liable for any indirect, incidental, or consequential damages including lost revenue or business opportunities.

7.8 Governing Law

This agreement shall be governed by the laws of the State of Florida, United States. Any disputes shall be resolved through binding arbitration.
